Management Measures for the Ancient Yellow River Canal Scenery Belt in Suqian
Article 1 In order to strengthen the protection and management of the scenery belts of the ancient Yellow River canal, and rational use of scenic spots resources, these Measures are formulated in accordance with the laws and regulations of the State Council's "Regulations on Scenic Spots" and "Regulations on the Administration of Scenic Spots in Jiangsu Province" and in accordance with the actual situation of this city.
Article 2 These Measures shall apply to the planning, construction, protection, utilization and management of the scenery belt of the ancient Yellow River canal.
Article 3 The ancient Yellow River canal scenery belt referred to in these measures refers to the ancient Yellow River-canal scenery belt scenic spot (hereinafter referred to as the scenic area) approved by the People's Government of Jiangsu Province, and its specific scope shall be implemented in accordance with the approved overall planning of the scenic area.
Article 4 The planning, construction, protection, utilization and management of scenic spots follow the principles of scientific planning, unified management, strict protection, orderly development, and rational utilization to promote the sustainable development of scenic spots.
Article 5 The Municipal People's Government shall establish a coordination mechanism for the protection and management of scenic spots to timely coordinate and handle major matters related to the protection and management of scenic spots.
The people's governments of Suyu District and Sucheng District shall establish or designate a special agency, which shall be specifically responsible for the protection of resources, greening management, and maintenance of facilities in the scenic area of the administrative area, rationally utilize the historical and cultural resources of the scenic area, and develop the tourism service industry in the scenic area , Cultural industries, characteristic businesses, etc., to enhance the overall quality of the scenic area.
The development zone (park) and tourist resort management institutions shall do a good job in the management of scenic spots in their own areas in accordance with the responsibilities stipulated by the municipal and district people's governments.
Article 6 The Municipal Natural Resources and Planning Department shall be responsible for the supervision and management of the scenic area and shall perform the following duties:
(1) Implementing the laws and regulations for the management of scenic spots, and formulating management systems, specifications, and standards for scenic spots;
(2) Responsible for the overall planning and detailed planning of the scenic area;
(3) Doing a good job in reviewing the construction projects of scenic areas and holding activities in accordance with the law;
(4) To do a good job of examining and approving forest harvesting in non-urban planning areas;
(5) Organizing inspections on the protection and management of resources in scenic spots;
(6) Coordinating relevant departments to improve tourism supporting services and conditions, do daily management, and maintain public order and environmental sanitation order in scenic spots;
(7) Laws, regulations and other work arranged by the municipal government.
The Municipal Scenic Spot Management Office is a scenic spot management agency set by the municipal government. It specifically manages the protection, development, and construction of scenic spots, and coordinates the management of other scenic spots in the scenic spot.
Article 7 The housing and urban-rural construction departments are responsible for the construction management and garden greening of urban parks in the scenic area; approve the work of transplanting ancient and famous trees, tree cutting and transplanting, and green space occupation within the urban planning area within the scenic area according to law.
The water resources department is responsible for the unified supervision and management of water resources in the scenic area, and carries out management, protection and comprehensive utilization of water conservancy facilities, waters and shorelines; maintenance, maintenance and management of the ancient Yellow River and canal embankments, maintaining river safety; Timely control beyond the scope; responsible for protection of drinking water sources in the Central Canal; responsible for tending and management of flood prevention forests in dikes in the scenic area.
The eco-environment department is responsible for supervising and protecting the water environment of the scenic area and supervising the implementation of water and soil pollution prevention and management; together with the water conservancy and other departments, it supervises and manages the environmental protection of drinking water sources in the scenic area.
The Ministry of Culture, Radio, Television and Tourism is responsible for guiding and coordinating the cultural and tourist public service work in the scenic area; supervising and managing cultural business activities and public cultural service activities in the scenic area; responsible for the inheritance of intangible cultural heritage and the protection of cultural relics in the scenic area; comprehensive coordination and supervision Manage the tourism security work of the scenic area; carry out comprehensive administrative law enforcement of the tourist market of the scenic area;
The transportation department is responsible for the safety management of water sightseeing activities in the scenic area; the river traffic and waterway safety management of the canal and the ancient Yellow River; responsible for the approval and filing of water and land vessels in the scenic area and crew training.
Public security organs are responsible for social security and road traffic management in the scenic area, and stop and investigate violations of public security and road traffic management regulations in the scenic area in a timely manner; guarantee the safety of large-scale mass activities in the scenic area, and protect the life and property of tourists in the scenic area Security work.
The agriculture and rural departments are responsible for the administration of fishery in the scenic area, and investigate and deal with illegal business aquaculture activities and illegal fishing activities in the scenic area according to law.
The market supervision and management department is responsible for supervising and managing the registration and operation of market entities such as commodity sales and tourism operations in the scenic area; safety supervision and management of special equipment; and organizing spot checks on product quality and food safety supervision and management in the scenic area.
The health department is responsible for supervising and managing the catering and food processing operations in the scenic area in accordance with the law.
The city management department is responsible for supervising, managing, and maintaining the public order, market order, and environmental sanitation order of the scenic area.
Article 8 Any unit or individual has the obligation to protect the resources of the scenic area in accordance with law, and has the right to report and stop acts that damage the resources, environment and facilities of the scenic area. Scenic spot management agencies should have clear reporting channels to facilitate the masses to report.
Article 9 The planning of scenic areas is divided into general plans and detailed plans, which are the basis for the construction, protection, utilization and management of scenic areas. The Municipal Natural Resources and Planning Department shall provide for them in accordance with the "Regulations on Scenic Spots of the State Council" and "Regulations on Management of Scenic Spots of Jiangsu Province". prepared by. Adjustment or modification of the scenic area plan must be submitted to the original approval authority for approval.
The formulation of the scenic area plan shall be coordinated with the overall urban planning, land use planning, construction of the Grand Canal Cultural Belt, and related special plans, highlighting the natural characteristics, cultural connotations, and local characteristics of the scenic area, and avoiding the tendency of artificialization and parkification.
Article 10 The planning of a scenic area shall be entrusted to a third-party institution with corresponding qualifications through public bidding or other means.
Article 11 The overall planning of the scenic area shall highlight the natural and human landscapes of the ancient Yellow River and the canal, and designate Xiang Wang's hometown, Qianlong Palace, and the ancient Yellow River Ecological Park as the core scenic spots.
The detailed planning of the scenic area shall be prepared according to the overall plan, and the site selection, layout and scale of the protection schemes and infrastructure, tourism facilities, cultural facilities and other construction projects shall be determined according to the different nature, characteristics and scope of the core and other scenic areas. Clarify the scope of construction land and planning and design conditions.
The overall plan and detailed plan shall be announced to the public in time after approval. Without planning approval in accordance with the law, various construction activities may not be carried out.
Article 12 Scenic areas are subject to hierarchical management and are divided into first-level control areas and second-level control areas. The core scenic area designated by the master plan is the first-level control area, and the remaining areas are second-level control areas.
The hotels, guest houses, resorts, nursing homes, training centers, and other buildings that are not related to the protection of scenic and scenic resources shall not be built in the first-level control area. Relevant construction activities in the second-level control area shall conform to the planning of the scenic area, and development and construction activities that destroy the landscape, vegetation, and topography shall not be implemented.
Article 13 The construction activities of the scenic area shall conform to the overall planning and detailed planning, and obtain relevant procedures according to law.
For approved construction projects in the scenic area, their construction units and construction units shall accept the supervision and management of the scenic area management agency and relevant departments.
Article 14 The layout, height, volume, shape, style and color of construction projects in the scenic area shall be coordinated with the surrounding landscape and environment.
The construction unit and the construction unit shall take effective measures to protect the scenery and surrounding vegetation, water bodies and landforms, shall not cause pollution and damage, and maintain the safety of the landscape and tourism. After the construction is completed, the site shall be cleared in time to restore the original environment.
Article 15 The Municipal Scenic Spot Management Office shall, in conjunction with relevant departments, investigate and register monumental buildings, cultural relics and historic sites, historical sites, garden parks and other cultural landscapes, and ancient natural trees, ecological wetlands and other natural landscapes. The Municipal Scenic Spot Management Office shall, in conjunction with the relevant scenic spot management units, inspect the hometown of Xiangwang, Qianlong Palace, Nanda Temple, Xuefeng Park, Zhu Rui Memorial Hall, National Water Resources Park, Canal Park Museum, Great King Temple, Imperial Wharf, Xiangwang Hand Planted Locust, Yang Sihong's tomb, twin towers and other important sights and key cultural relics shall be investigated and registered, special archives shall be established, special protection measures shall be formulated, and key protection shall be carried out.
Article 16 The forests in the scenic area shall be managed with tending, and logging is strictly prohibited except for tending and renewal. For renewal, tending and felling, the examination and approval procedures shall be completed in accordance with the law.
Article 17 Public security organs shall set up traffic signs for scenic spots and related scenic spots on traffic roads to guide tourists to travel.
Scenic spots management units shall set signs such as tour routes, tourist information, safety warnings, and precautions in the spots, and set fire ban signs in forest areas, cultural relics protection units, and important scenic spots.
Article 18 The parking lot management unit in the scenic area shall regulate the management of the parking lot, maintain the order of parking of the vehicles, reasonably charge, clearly mark the price, and protect the safety of tourists and their property.
Article 19 The development and utilization of resources in the scenic area shall be planned in accordance with the overall planning and detailed planning of the scenic area and its functional requirements, and cultivate special features such as culture and entertainment in the scenic area.
Article 20 Posting commercial advertisements, holding large-scale amusement and other activities in the scenic area, and carrying out activities that change the natural state of water resources and the water environment shall be reported by the Municipal Scenic Spot Management Office in accordance with the relevant laws and regulations Approved by the competent authority and put in place corresponding protective measures.
Article 21 The scenic spot management unit shall reasonably set up business service outlets.
Service items such as sightseeing, transportation, and commercial services for scenic spots in the scenic area shall be selected by the scenic spot management unit through bidding and other methods. When signing a contract with the operator, the scenic spot management unit shall clearly clarify the responsibilities for the operation and maintenance and safety management of the facilities in the scenic spot.
Units and individuals engaged in business activities in the scenic area shall consciously abide by the regulations for the management of the scenic area and conduct business activities in accordance with the law in designated areas and locations. It is forbidden to set up tents, set up booths, set up points, or expand the operating area without authorization.
Article 22 The following acts are prohibited in the scenic area:
(1) acts of damaging greenery, such as climbing flowers and trees, picking fruits, and destroying lawns;
(2) unauthorized capture of wild animals and aquatic plants;
(3) Spitting, drowning, littering;
(4) Burning leaves, garbage, and coins;
(5) Climbing, moving, scoring, smearing, or damaging the fences, pavilions, sculptures, signs and other facilities in the scenic area without authorization.
(6) Activities such as land reclamation, grave repairs, and monuments destroying landscapes, vegetation, and topography.
(7) Construction of facilities for storing explosive, flammable, radioactive, poisonous and corrosive materials.
Article 23 Suyu District, Sucheng District People's Government, and development zone (park), tourism resort management institutions shall strengthen protection of the waters of the scenic area, improve the water quality of the waters of the scenic area, and improve the ecological environment of the waters of the scenic area.
The drainage channel of the ancient Yellow River from the Zaohe River Gate to the orchard rubber dam shall not be provided with a new sewage outlet.
The establishment of sewage outlets in other sections of the ancient Yellow River and canals in the scenic area shall comply with the laws and regulations of the People ’s Republic of China Water Pollution Control Law, the Water Law of the People ’s Republic of China, and other relevant national regulations.
Article 24 The water conservancy department shall regularly monitor the sedimentation of the ancient Yellow River, and formulate a dredging and dredging plan based on the monitoring results, which shall be implemented after being approved by the people's government at the same level.
Article 25 Suyu District, Sucheng District People's Government, and development zone (park), tourist resort scenic area management agencies shall report to the Municipal Scenic Spot Management Office the implementation and protection of the previous year's scenic area before the end of February of each year.
Article 26 Relevant administrative organs, scenic area management agencies and their staff who engage in malpractices, abuse of power, and neglect of duties in the management activities of scenic areas shall be punished by their units or superior authorities in accordance with law; if a crime is constituted, criminal prosecution shall be investigated responsibility.
Article 27 These Measures shall be implemented as of the date of promulgation.
